WHY DID I GET SUED?

 

Before Amerilit received notification of your lawsuit you were served with legal papers by a law enforcement official or process server.  This person came to your door and handed you or someone who resides with a copy of the legal papers.  Alternatively, you may have received a letter containing the legal papers or even found them posted on your door.  Amerilit understands that being sued is an upsetting and stressful event.

When a client is sued, often their first question is “[W]hy did I get sued?” Clients are often confused about why they were sued. It is not possible to predict which creditors will choose to file a lawsuit rather than reaching a settlement with you on an account: 

 

1.                  Time may be running out for the creditor to bring a lawsuit.  Laws called the statute of limitations prohibit a creditor from filing a lawsuit if the debt is too old from the date of the last payment.  The amount of time that triggers the statute of limitations time is different for each state.

2.                  The creditor may have charged off the account. A charged off account is one that the creditor has decided that they will not be able to collect the money owed to them.  The time frame for categorizing a debt as charged off is different for each creditor.  A debtor is still responsible for a charged-off debt. Charged-off does not mean the debt is forgiven.

3.                  The creditor has sold the debt to a debt collection lawfirm. Debt collection lawfirms buy debts and are financially incentivized to bring lawsuit to collect on the debts they have bought.
